1. Introduction

Welcome to Radiowiz, a service provided by Maxme Digital Media (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the Radiowiz service (“Service”), whether accessed via our website or mobile application.

By using the Service, you agree to comply with these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Definitions

– Broadcaster: Any radio personality, broadcaster, aggregator, or restreamer who uploads content to or utilizes the Radiowiz service.
– Content: Any streams, images, audio, text, or other materials uploaded to or made available through the Service.

3. Authorization and Rights

3.1. Content Authorization

By uploading Content to Radiowiz, you represent and warrant that you have all necessary rights, licenses, consents, and permissions to use and authorize Radiowiz to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all Content.

3.2. Grant of License

You grant Radiowiz a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service.

4. User Responsibilities

4.1. Accurate Information

You agree to provide accurate, current, and complete information as required for the registration and use of the Service.

4.2. Compliance with Laws

You agree to comply with all applicable laws and regulations when using the Service.

5. Intellectual Property Rights

5.1. Ownership

All Content uploaded by you remains your property. However, by uploading Content to Radiowiz, you grant Radiowiz the rights outlined in Section 3.2.

5.2. Trademarks and Logos

Radiowiz’s trademarks, logos, service marks, and trade names are owned by Maxme Digital Media. You agree not to use these without prior written consent from us.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Radiowiz, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service.

7. Indemnification

You agree to indemnify and hold harmless Radiowiz, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

8. Advertising Revenue

Radiowiz does not share app revenue. Revenue from the streams is managed by the stream provider, and Radiowiz does not have any relationship with the stream providers regarding revenue sharing.

10. Modifications to Terms

Radiowiz reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Service. You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the use of the Service shall be resolved by local arbitration in Ghana, in accordance with the rules of the Ghana Courts.
